To ensure that Maximum Gym 24/7 provides all members with a pleasant and safe experience, all members must adhere to Maximum Gym guidelines and policies Membership Agreement. If you have any inquiries or suggestions, please contact a staff member or send email.
You agree to abide by all membership regulations at Maximum Gym. You agree to comply with stated and customary rules for participation and use of equipment.
By agreeing to become a member at Maximum Gym, you are legally bound by these terms and conditions. In the event of a breach of membership rules and regulations, Maximum Gym reserves the right to refuse admission to member or guest, to require any member or guest to leave the premises, and disable a member's access key. You have no right to assign or otherwise transfer your rights in this agreement to any other person.
Maximum Gym may make reasonable changes to these rules from time to time with advance notice.
Facilities and Equipment: All weights, equipment, and any gym property must be put back in the appropriate place. Failure to do so will result in a written or verbal warning by staff. Any violation after three warnings will result in termination of your membership.
Members must immediately report any breakage or damage to equipment to Maximum Gym management or staff.
Cleanliness and Hygiene: Members must bring their own hand towel and wipe down equipment after use.
If you forget your towel, you may purchase borrow one from the gym and place it in the linen basket provided.
Appropriate gym wear: Members are asked to dress appropriately for their workouts and wear suitable training shoes at all times while in the Maximum Gym.
Appropriate gym wear DOES NOT include the following:
Work-boots, thongs, sandals, high heels, or bare feet
Gym pants or shorts with protruding studs or side zips (to avoid damage to equipment)
Skimmpy or revealing clothing
Work suits or work overalls
In consideration of others, in hotter weather please shower or use deodorant prior to arriving at Maximum Gym.
Inappropriate Behavior: Members must conduct themselves with appropriate decorum whilst at Maximum Gym and treat others with respect at all times. Foul language and inappropriate behavior will NOT be tolerated.
The response to inappropriate language or behavior will range from a verbal warning to immediate expulsion from the gym.
Personal Property: Although we have attempted to make our facilities as secure as possible by installing security cameras above the cubby hole areas used by members and guests for their personal items, Maximum Gym accepts no liability for goods taken from the property.
Any lost property will be kept for 2 weeks, after which, if unclaimed, will either be discarded or donated to charity.
HOURS AND ACCESS
Staffed Hours : Maximum Gym reserves the right to vary the staffed hours as considered necessary for the proper operation of the gym.
24/7 Access Key: As part of your membership, you will be issued with a 24/7 access key. On every visit to Maximum Gym, you must swipe the key on entry and exit. If you lose or damage your access key, you can purchase a replacement from the office for $60
Guest Access: Members can bring guests to use the facilities of Maximum Gym by purchasing a guest day pass from Reception for $8. All guests must complete a guest registration form, and must be accompanied by a member. Members are responsible for the conduct of their guests at all times whilst they are on the premises and for ensuring that their guests comply with the rules and conditions of their membership.
Tailgating: Do not allow others to enter the building with you or enter as you are leaving. All members must access the building with their own access key. For your own safety and the safety of others, do not allow others to enter who claim to have forgotten their key or who knock on the door or window.
Maintenance Closures: Maximum Gym reserves the right to close temporarily for periods of up to two weeks each year for maintenance purposes.
6 and 12 Month Memberships can be payed in full and upfront or via monthly direct debit from either a bank account or a credit/debit card.
In addition to membership fees, members must also pay a one-time administration fee and a security access fee, which includes an access key.
Fees are due regardless of whether you have used Maximum Gym facilities.
PLEASE NOTE, the initial monthly agreement is for a minimum of 12 months “the initial membership Term”
CANCELLATION, REFUNDS AND SUSPENSION
Cooling-Off Period:You have seven days from the signing of this agreement to change your mind and receive a refund of all monies paid minus direct debit fees.
Refunds: After the initial seven-day cooling-off period, members are not eligible for a refund of advance payments except as noted in the Cancellation Policy. Any right to a refund will be limited to the right to terminate the Membership Agreement pursuant to its terms or Australian Consumer Law.
Cancellation Policy: Once past the "initial minimum membership term", direct-debit members can cancel their membership by providing 30 days notice in writing.
During the initial membership term or year-long commitment, you can cancel your membership with 30 days notice in writing due only to a certified medical condition that precludes any form of regular exercise offered by Maximum Gym now or in the future (requiring a doctor's certificate) or if you move more than 10 km radius from the gym (requiring proof of relocation).
Cancellation Policy for NO CONTRACT: Members can cancel their membership by providing 30 days notice in writing to Maximum Gym management.
Temporary Suspension of Membership: You may suspend your membership for a minimum of two weeks and a maximum of eight weeks for a 6, 12 or 18-month membership. In cases of exceptional medical circumstances, longer suspensions may be granted on presentation of a medical certificate. You must advise us of your intention to suspend prior to your absence and complete the relevant paperwork. You can obtain a Membership Suspension Form from the office during staffed hours or request one by email. The duration of the suspension time will be added on to your membership term, or your debit amount will decrease for that month, as applicable.
DIRECT DEBIT PAYMENTS
You must complete and sign the Recurring Direct Debit Authorization Form nominating a bank account for the term of this Membership Agreement. You agree to sign all documents necessary to ensure that monthly payments can be made by direct debit.
Note - Direct debit memberships are ongoing, so debits will not automatically stop when the initial term is completed . You must notify Maximum Gym if you want to stop your direct debit payments once your initial membership term is completed.
Missed or late payments: Missed or late payments will result in late fees and charges, which are your responsibility.
Failure to make payments: Failure to make payments will result in the disabling of the member's access key.
SAFETY AND HEALTH
Maximum Gym Emergency Procedures are in place for the safety of its members and guests, it is your responsibility to make yourself familiar with these procedures. If you have any questions contact Maximum Gym management or staff.
Health: Throughout the term of your membership, we recommend regular health and medical screenings by your General Practitioner, especially when starting a new exercise program or significantly changing your program. If any new injury or health problem should arise during the course of your membership, inform a staff member so we can advise you on any possible changes to best practices with your workout or use of equipment.
Accidents, Incidents, or Problems: For your safety and the safety of others, members are expected to immediately report any accidents, incidents, or problems with services and or facilities to Maximum Gym management or staff.
First Aid Kit: The portable first aid kit is located next to the main male toilets (the block of toilets closest to the main ramp entrance)
Emergency Alert Necklaces: Are provided by Maximum Gym for the safety of its members and guests. Emergency Alert Necklaces must be worn at all times whilst training at Maximum Gym during non staffed hours. Emergency Alert Necklaces are located below the first aid kit and next to the main male toilets (the block of toilets closest to the main ramp entrance)
Distress Button One: For emergency assistance press the RED EMERGENCY BUTTON, located next to the main female toilets (the block of toilets closest to the main ramp entrance)
Distress Button Two: For emergency assistance press the RED EMERGENCY BUTTON, located on the outside office wall (next to the three steps for access to the lower level gym floor)
Fire and Emergency Exits: Australian Law requires public exit points to be accessed easily, therefore all exit points at Maximum Gym must remain unlocked from the inside for members to depart the building safely and easily, however once exit doors are opened Maximum Gym security system procedures are activated, as well as loud sirens will be initiated.
Evacuation Procedure: In the event of a building evacuation all members are required to EXIT the nearest door and assemble at the corner of Jacks and Center Road on the grassed area, and must wait for proper authorities to arrive.
MAXIMUM GYM DISCLAIMER OF LIABILITY
All members and their guests accept there is a risk of injury associated with participating and using Maximum Gym facilities. Maximum Gym will endeavor to make the use of our facilities as safe as possible; however, we cannot accept responsibility for damage or injury through the misuse of Maximum Gym facilities and equipment.
"Back to Basics" classes are offered by Maximum Gym to familiarize members with Life Fitness and Hammer Strength Equipment. Classes must be completed prior to using any equipment or acquiring a personal program.
We will obtain personal information from you when you complete an online or printed Membership Agreement. We might also collect your details by email messages sent to Maximum Gym, sign-up information forms, or gym viewing cards during gym tours/visits.
Personal Information Maximum Gym Requires: The types of information we collect includes name, date of birth, e-mail address, postal address, telephone number, credit card details, and information regarding your health.
Note that we do not store your credit card details on our web servers: this information is securely stored with a third-party, bank-approved firm with whom we have contracted to collect payments.
By providing us with your personal data, including sensitive personal data such as your health status, you consent to the collection of any information you have provided. Personal data will only be used and collected for your own health and safety benefits.
You have the right to ask for a copy of the information we hold about you and to have any inaccuracies in your information corrected. If you have any questions or concerns, speak to gym management or contact us by email.
Changes to Your Personal Information: If your details of your personal information change, please help us to keep your information up to date by notifying us during staffed hours or by email.
